Ericsson is the owner of US Patent “Appl No: PCT/EP2012/053555” If the claims of the Ericsson patent Appl No: PCT/EP2012/053555 and subsequent applications and patents from said application are technically necessary for practicing the Web Real Time Communication (hereinafter “WebRTC Standard”) Internet Standard as set by IETF, any party will have the right to use any such patent claims under reasonable, non-discriminatory terms, with reciprocity, to implement and fully comply with the said WebRTC Standard. The reasonable non-discriminatory terms are: If this WebRTC Standard is adopted, Ericsson will not assert any claims of the patent Appl No: PCT/EP2012/053555”, as owned or controlled by Ericsson against any party for making, using, selling, importing or offering Web Browser, either as stand alone items, or as integrated into products; all however limited to the portion of the operative system portion that implements the WebRTC standard, and further provided, however that Ericsson retains the right to assert its patents (including the right to claim past royalties) against (i) any other portion of such operative system not implementing the WebRTC Standard, or any other part of the product that implements such operative system, or against any other implementation of the WebRTC Standard other than for purposes of Web Browsers, or against all other products, and/or (ii) any party that asserts a patent it owns or controls (either directly or indirectly) against Ericsson or any of Ericsson's affiliates or successors in title or against any products of Ericsson or any products of any of Ericsson's affiliates either alone or in combination with other products; Royalty-bearing licenses will be available to anyone who prefers that option, as well as for use of the WebRTC Standard outside of the scope of said operative systems. |
