To the extent technology of the document is included in a draft standard, and
any claim of any patent issued on the identified patent application or
corresponding patent applications would necessarily be infringed when fully
implementing such standard, Telefonaktiebolaget LM Ericsson will make available
licenses to such patent claims on fair, reasonable, reciprocal and
non-discriminatory terms and conditions, to any implementor for making, using,
selling or offering for sale products or services fully compliant with the
standard.
Reciprocity means that any tentative licensee, who owns or controls patents, in
order to get the license has to license, or commit to make available licenses
to, claims of the owned or controlled patents and unavoidably infringed by
implementation of the standard, on coresponding fair, reasonable and
non-discriminatory conditions or royalty-free conditions, to Telefonaktiebolaget
LM Ericsson and its affiliates for making, using, selling or offer for sale
products or services fully compliant with the standard.
For the avoidance of doubt any tentative licensee, who does not own or control
any patent with any claim unavoidably infringed by implementation of the
standard, does not have to license any patent to Telefonaktiebolaget LM Ericsson
or its affiliates in order to get the license from Telefonaktiebolaget LM
Ericsson.
