In 2009, Ineovation submitted the draft draft-badra-hajjeh-mtls-02. The document defines an extension to negotiate the application layer type in a similar way as described draft-ietf-tls-applayerprotoneg.Pasi Eronen, the TLS's co-chair during 2009, didn't support the publication of the draft because of the patent.
