Other info

Based on a ruling from the US Appellate Court on Thursday of this week my petition to strike as unenforceable the Settlement Agreement was affirmed meaning the Settlement Contract is NOW FULLY VETTED BY THE APPELLATE COURT FOR ENFORCEMENT. That means any protocols which contained methods of US6370629 as well as the LBS and Digital Certificate based protocol standards all require mandatory compliance with the Settlement Terms meaning the IETF AND ITS MEMBERS ARE BOUND BY THIS DOCUMENT http://www.slideshare.net/tglassey/contractsddisettlement AND ITS SECTION 8.1 TERMS.

That means ALL of the IETF and ITU Standards this effects including those used in creating the code inside the routers, switches and computers (both Client and Server) are tied to this same requirement now. That everyone using them agree that the data touched by the execution of that code is tied to the Laws of the State of California and any Contracts using that Data are likewise tied to the Laws of the State of California.

For the record we formally moved numerous times to have the Settlement set aside, and first the State and then the US District court blocked and then the Appellate Court affirmed that blocking the Setting Aside of the Settlement by its dismissal.

So now that Contract is pretty much cast in Concrete and its time for everyone to come into conformance with it or purchase the FRAND Release from the CALIFORNIA LAW LICENSING CLAUSE WHICH FUNCTIONALLY IS THE KEY OPEN-SOURCE TERM FOR THE USE OF THIS IP.

The Patent Holder states that its position with respect to licensing any patent claims contained in the patent(s) or patent application(s) disclosed above that would necessarily be infringed by implementation of the technology required by the relevant IETF specification ("Necessary Patent Claims"), for the purpose of implementing such specification, is as follows(select one licensing declaration option only):

See Text Below for Licensing Declaration Licensing Reasonable and Non-Discriminatory License to All Implementers with Possible Royalty/Fee

Please be advised that I (Todd S. Glassey), Michael McNeil and Datum (Symmetricom now)
to varying degrees jointly hold rights to a patented set of technologies as specified in
EuroPatent # EP 0 997 808.

My and Mc Neil's rights therein are identified in a settlement agreement in addition to
the patent and so the settlement agreement is a key piece in understanding the scope of
licensable rights and their applicability. This includes, but is not limited to the
Glassey GeoSpatial Keying ** and Evidentiary Digital Testimony Models and encompasses
what is referred to as Phase One technologies in the settlement between Datum and us.
All rights to Phase Two technologies rest with GMT.

If there is an issue with this claim or you are interested in licensing this technology,
contact me through my attorney, Dennis Kennelly Esq, at 650-853-1291.

** GeoSpatial keys are elements of location data from GPS or other sources, that are
used a part of a cryptographic or evidentiary process within a digitally signed model.
The use of geospatial keying allows for mechanically placed constraints to be setup on
digital events so that they are particular to their physical location. One example of this
would be the use in Cell Phones, but the reverse model is useful also as part of digital
evidence statements based on a particular location.
