Date: 2002-03-22 This is very important since the Bradner document RFC3979-bis doesn't take into account that the copyright standards extend to the methods used from those patents and grant the patent holder a co-copyright standing in any and all publications made through the IETF standards process or its publication channels. This provides those co-copyright holders with any and all copyright controlled rights including monetization demand rights for uses of the network protocols in any parties products derived from an IETF Standard. |

The IETF has in many instances included patent protected methods in the documents it publishes which did not get disclosed to the patent holders, or their owners/assignees. In this software and firmware appliances using those methods was published outside of the licensing those patent protected methods brought into the process. The IPR methods of the IETF *** MUST *** be updated to properly notice that the IP Rights of an owner extend into the co-copyright standing of any document published by the IETF and persist through the full term of the Standard Documents (RFC, BCP etc) publication. This may have the effect of extending the legal term the IP in the patent is protected and should be considered as part of the term of enforcement model in use today. It clearly affects RFC3979-bis and any later IPR related publications by the IETF. As such it is germane to the publication of standards by IETF and their enforcement in the IPR realm. |
