Broadpeak, S.A. has one patent family identified here below (“Patent”) that include one or more claims that Broadpeak believes may be essential for implementing technology set forth in "https://datatracker.ietf.org/doc/draft-bichot-msync/", depending on the implementation selected by the implementer, (“Essential Claims”).
In the event that Essential Claims are necessarily infringed by the implementation of “https://datatracker.ietf.org/doc/draft-bichot-msync/”, Broadpeak agrees, upon written request from a third party, to negotiate with that party, a non-sublicensable license to such Essential Claims, under reasonable and non-discriminatory terms and conditions, and solely provided that the requesting third party grants to Broadpeak and its affiliates, a reciprocal license, and to the full extent permitted by the applicable laws, provided that the license from Broadpeak is canceled and terminates if the party initiates a claim of patent infringement, directly or indirectly, against Broadpeak, or its affiliates.
