VI. Licensing Declaration

The Patent Holder states that its position with respect to licensing any patent claims contained in the patent(s) or patent application(s) disclosed above that would necessarily be infringed by implementation of the technology required by the relevant IETF specification ("Necessary Patent Claims"), for the purpose of implementing such specification, is as follows(select one licensing declaration option only):

IBM will offer a royalty-free non-exclusive license to the necessary patent
claims of the referenced patent, as defined with respect to and for the fully
compliant implementation of the referenced IETF RFC 3530. The granting of the
patent license for US 5931913 is contingent upon the grantback of licenses, by
the licensee, for the use of necessary patent claims, required by this RFC, to
IBM under comparable terms for the compliant implementation of the referenced
RFC (including RFC's 3010, 1813, 1094, and 2339 referenced by RFC 3530).
In the event the licensee / prospective licensee or any of its subsidiaries has
brought or asserts any claim for patent infringement against IBM or any of its
subsidiaries, IBM has the right to unilaterally suspend, terminate, withdraw the
offer or withhold the grant of the license / prospective licensee to the
licensee and its subsidiaries.
