Update Received: April 24, 2003
From: Eric Burger

The letter sets forth the position of SnowShore Networks, Inc. ("SnowShore") with regard to
the following specifically identified standards activity of the IETF:

Media Server Control Markup Language and Protocol (MSCML)
                                    ("The Standard")

SnowShore may have one or more patent applications pending that have claims that would
be applicable to products conforming to the Standard upon issuance of the patent(s).
In the event SnowShore obtains a patent having one or more claims applicable to the
Standard, SnowShore shall grant to other entities a royalty free, non-exclusive license
to manufacture, use and/or sell products that are covered by claims of any such patent,
provided that the license under such claim(s) is necessary to practice the Standard.
The license to be granted by SnowShore (a) will not apply to any claim of any SnowShore
patent, whenever issued, that is not necessary to practice the Standard, and (b) does not
extend to any entity or a subsidiary of such entity, that will not grant to SnowShore a
reciprocal license to manufacture, use and/or sell products conforming to the Standard upon
the terms offered hereunder with respect to patents owned by such entity or a subsidiary or
organization controlled by such entity.

SnowShore may seek patent protection on technology described in documents which
SnowShore submits for use in IETF standards discussions.  In relation to any IETF
standard incorporating any such technology, SnowShore will grant a royalty free
non-exclusive license to Qualified Parties to utilize such technology if necessary
for practice of IETF standards implemented as a result of SnowShore's submission. As
used herein, Qualified Parties means a party who has not, does not and will not
assert, in litigation or otherwise, including in licensing discussions, any patent or
other intellectual property right against SnowShore. Any such license to a Qualified
Party shall terminate at once if such party asserts a patent or other intellectual
property right against SnowShore. SnowShore will grant non-exclusive licenses to
Non-Qualified Parties on reasonable, reciprocal non-discriminatory terms and
conditions.
