Arista hereby grants to you a perpetual, worldwide, non-exclusive, no-charge, irrevocable (except as stated otherwise) patent license to make, have made, use, offer to sell, sell, import, transfer, and otherwise run, modify and propagate implementations of the Specification. If technology in the Specification is included in a standard adopted by IETF, such license applies only to those patent claims, both currently owned by Arista and acquired in the future, licensable by Arista that must necessarily be infringed because of what is specifically required by the normative portions of the Specification. This license is offered on the condition that you grant a reciprocal license under the same terms as this license to all parties for implementations of the Specification under those patent claims, both currently owned by you and acquired in the future, licensable by you that must necessarily be infringed because of what is specifically required by the normative portions of the Specification. If you or your agent or exclusive licensee institute or order or agree to the institution of patent litigation against any entity (including a cross-claim or counterclaim in a lawsuit) alleging that any implementation of the Specification constitutes direct or contributory patent infringement, or inducement of patent infringement, then any patent rights granted to you under this license shall terminate as of the date such litigation is filed.

Notwithstanding whether the Specification is included in a standard adopted by IETF, Arista retains the right to assert its patents (including the right to claim past royalties) against any party that asserts a patent it owns or controls (either directly or indirectly) against Arista or any of Arista's affiliates or successors in title or against any products of Arista or any products of any of Arista's affiliates either alone or in combination with other products.
