Verisign is owner of U.S. Patent Application Nos. 18/219,522, 18/137,992, and 18/137,966 (collectively, the "Patent Applications" or "Intellectual Property") relating to the subject matter of the Internet-Draft entitled "Stateless Hash-Based Signatures in Merkle Tree Ladder Mode (SLH-DSA-MTL) for DNSSEC" and any successive versions deriving therefrom (collectively, the "I-D"). In furtherance of IETF standardization, it is Verisign's business practice to make licenses to its Intellectual Property available on fair, reasonable, and nondiscriminatory terms and conditions. Accordingly, Verisign hereby discloses the listed Intellectual Property that may Cover an Implementing Technology of the I-D and declares the license grants below, with additional Licensing Declaration(s) and terms to be provided later if the listed Intellectual Property would otherwise necessarily be infringed by the Implementing Technology ("Necessary Patent Claims"), which implies a willingness to commit to the provisions of a) a royalty-free and otherwise reasonable and non-discriminatory license (e.g., with terms to include attribution and/or a covenant not to sue with or without defensive suspension as described in Section 7 of BCP 79), or b) a license that contains reasonable and non-discriminatory terms and conditions (e.g., with terms to include attribution and/or a covenant not to sue with or without defensive suspension as described in Section 7 of BCP 79), including a reasonable royalty or other payment, or c) without the need to obtain a license from Verisign (e.g., a covenant not to sue with or without defensive suspension as described in Section 7 of BCP 79). Standards Development Grant. Verisign grants to any party a world-wide, non-exclusive, royalty-free license under said Intellectual Property to make, use, and/or import products and/or services that implement such I-D for the sole purpose of facilitating the standardization of such I-D; provided, (A) any such party making, using, and/or importing such products or services, shall include therein, or shall ensure that such has been included therein, an attribution notice as set forth below, and further provided, (B) Verisign retains the right to terminate the above license and assert its Intellectual Property (including one or more claims of said Intellectual Property that would necessarily be infringed due to requirements for practicing the normative portion(s) of the I-D (each an "Essential Claim")) against any party that institutes or agrees to institute patent litigation (including cross-claims or counterclaims in a lawsuit), either directly or indirectly, against Verisign or any of its affiliates or licensees for making, using, selling, offering for sale, and/or importing products and/or services that implement the I-D. The Standards Development Grant will terminate upon the earlier of either expiration of the I-D or when the I-D is published in the Request for Comments ("RFC") Series. Attribution Notice for Standards Development Grant: "This product is licensed under patents and/or patent applications owned by VeriSign, Inc. in furtherance of IETF standardization which helps support the security, stability and resiliency of the Domain Name System (DNS) and the internet. For more information about the patents, visit www.verisign.com/Declarations." Grant on Standardization for MTL Mode for DNSSEC Implemented Using Binary Rung Strategy. In the event such I-D, provided it includes the Technology as defined herein, is published as an Experimental, Informational, or Standards Track RFC, as described in RFC 2026 and its successors, (referred to herein as "RFC") such that one or more claims of patents that issue from said Patent Applications would necessarily be infringed due to requirements for practicing the normative portion(s) of such RFC to implement the Technology (each an "Essential Claim"), Verisign hereby revokes the Standards Development Grant above and grants to any party a non-sublicenseable, perpetual, world-wide, non-exclusive, no-charge, irrevocable (except as provided below) license under the Essential Claim(s) solely to implement the Technology to make, use, sell, offer for sale and import products and/or services that implement the RFC; provided, any such party making, using, selling, offering for sale, and/or importing such products or services, shall (A) prominently and publicly display, or shall ensure that such has been prominently and publicly displayed, an attribution notice on all such products or services, as set forth below or which Verisign has authorized in advance and in writing, and (B) send a notice to licensing@verisign.com that i) identifies such products or services, ii) confirms such products or services implement the Technology in conformance with the subject RFC, and iii) identifies the location of the attribution notice for approval by Verisign; further provided, (C) Verisign retains the right to: (i) terminate the above license, to the extent permitted by applicable laws, and assert its Essential Claims against any party that: a) institutes or agrees to institute patent litigation (including cross-claims or counterclaims in a lawsuit), either directly or indirectly, against Verisign or any of its affiliates, and/or The "Technology," as used herein, means Merkle Tree Ladder (MTL) Mode for DNSSEC, as described in the I-D, including that the Merkle tree ladders to be signed using an underlying signature scheme are solely implemented using the Binary Rung Strategy. "Binary Rung Strategy" means the strategy wherein the first rung of a Merkle tree ladder is the apex of the largest perfect binary tree that can be formed from the consecutively indexed data values, starting from the left; each subsequent rung of the Merkle tree ladder, if any, is the apex of the largest perfect binary tree than can be formed from the consecutively indexed data values, starting from the left, that were not included in one of the perfect binary trees associated with a previous rung; and the sizes of the perfect binary trees decrease from left to right. Royalty-bearing licenses will be available to anyone who prefers that option.
