Apple Inc. (“Apple”) has one or more pending unpublished patent applications (“Subject Patent Application(s)”) that include one or more claims that Apple believes may be essential for implementing technology set forth in draft-detecting-unwanted-location-trackers-00 ("Detecting Unwanted Location Trackers") (“Essential Claims”). In the event that any patents issue from the Subject Patent Application(s), Apple agrees, upon written request from a party, to negotiate with that party a non-sublicenseable license to the Essential Claims under reasonable and non-discriminatory terms and conditions, solely to the extent necessary to implement required portions of the Informational Internet Draft, provided that the party grants a reciprocal license to Apple and provided that the license terminates if the party initiates a claim of patent infringement, directly or indirectly, against Apple, its subsidiaries, or its affiliates.

Apple Inc. (“Apple”) has a pending unpublished patent application (“Subject Patent Application”) that includes one or more claims that Apple believes may be Essential for implementing technology set forth set forth in the Internet-Draft entitled “Detecting Unwanted Location Trackers” (draft-detecting-unwanted-location-trackers-00) (“Internet-Draft”).

In the event that (a) one or more patents issue from the Subject Patent Application, (b) a version of this Internet-Draft is published by the IETF as an RFC (the “RFC”), and (c) one or more claims of a patent that issues from the Subject Patent Application are Essential, then any party will not be prevented from using such patent claims (“Essential Claims”) under reasonable, non-discriminatory terms, with reciprocity, to implement and fully comply with the RFC.

The reasonable, non-discriminatory terms are:

Apple covenants not to assert Essential Claims against a party’s making, using, selling, importing or offering for sale a product that implements and fully complies with the RFC, but such covenant only applies with respect to and solely for the purposes of such party’s implementing the RFC. Notwithstanding the foregoing covenant, Apple retains the right to assert the Essential Claims (including the right to claim past royalties) against any party or affiliates of such party that asserts any patent against Apple, any of Apple’s affiliates or successors in title, or any third party in connection with products (including components) or services made, used, sold, imported, exported, distributed or otherwise provided or disposed of by or for Apple; and Apple retains the right to assert the Essential Claims against any product, service or portion of either of the foregoing that is not necessary for compliance with the RFC.

Royalty-bearing licenses will be available to anyone who prefers that option.

“Subject Patent Application” means US18309492.

“Essential,” as applied to a patent claim, means that it is not possible on technical (but not commercial) grounds, taking into account normal technical practice and the state of the art generally available at the time of standardization, to make, use, sell, offer for sale, or import a product or service that complies with the RFC without infringing that patent claim.
